HEMPSTEAD LANDFILL CASE CHANGE OF VENUE HEARING

  

After hearing testimony today (Monday) in a change of venue request for the Hempstead Landfill case, an interim judge is expected to make a ruling soon.

Former 21st District Court Judge Terry Flenniken heard testimony this (Monday) morning from Dallas based Pintail Landfill Company.  The company is asking the 506th District Court to move the case from Waller County due to local prejudice and publicity in the three year landfill dispute.  Waller county residents have been fighting the proposed location of the 15 story landfill near Highway 6 ever since it was announced.  The lawsuit contends that the project was discussed and pushed forward illegally through backroom talks between developer Green Group Holdings and Waller County officials.

Arguing against moving the lawsuit case to another county were the plaintiffs, the City of Hempstead and the group “Citizens Against the Landfill in Hempstead”.

Besides Pintail Landfill Company, other defendants named in the suit include former Waller County Judge Glenn Beckendorff and Commissioners Frank Pokluda, Stan Kitzman, Jeron Berrett and John Amsler.
