BRENHAM MAN ARRESTED ON ASSAULT WITH A DEADLY WEAPON CHARGE

  

A Brenham man has been arrested on an Assault with a Deadly Weapon Charge.

On Tuesday at around 6:48pm, Officer Sierra Newell and Corporal Steven Eilert responded to a report of a theft at 1500 Farewell St at an apartment complex.

While at the scene taking the report, the sound of a gunshot from the Guadalajara Mexican Restaurant was heard.

Cpl. Eilert went to investigate, and observed a vehicle at the Guadalajara Restaurant with several occupants  speeding away from the scene. One of the persons in the vehicle attempted to run from the scene.

He was located in the apartment complex parking lot.

The others in the vehicle were ordered out.

Arrested was eighteen-year old Tyrone Ray Scyrus, Jr. of Brenham, who was charged with Aggravated Assault with a Deadly Weapon. Scyrus was searched and a .380 caliber pistol was found in his possession.

Police discovered that Scyrus had been in an altercation earlier in the day with another individual, in which it was discovered that he had fired a shot at that individual earlier in the day.

The other occupants of the fleeing vehicle were identified and released.

  1. Penal 38.02 means that Texas is not a stop and identify state. This means there’s no law that passengers in car have to show their i.d. to the police. Just because a police officer thinks someone has a warrant, doesn’t mean that they have to show an I.D.. Unless you’re arrested or driving you have no obligation to provide identification. Know the law and use it, before you loose your rights.

  3. Texas penal code 38.02 says a person must identify themselves ONLY if you’re the driver of the vehicle or if you’re arrested for a crime then you must give your I.D. to a police officer.

    If your not driving a car and you haven’t been placed under arrest you have every right NOT to present an I.D. to a police officer. It’s the law!

      Sec. 38.02. FAILURE TO IDENTIFY. (a) A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information.

      (b) A person commits an offense if he intentionally gives a false or fictitious name, residence address, or date of birth to a peace officer who has:

      (1) lawfully arrested the person;

      (2) lawfully detained the person; or

      (3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal offense.

        I must have completely missed something here. How is Texas penal code 38.02 coming into play here? I didn’t see where anyone refused to give there identification?

    2. These young people were riding in a car with a person who had a gun and used it. The cops had reasonable suspicion his so called “friends” may have warrants. Why would you defend this? As a parent I taught my children to always obey the police. If you are not in a situation like this in the first place, you shouldn’t have to worry about your “rights”.

    3. Why did this 18 year old have a gun in the first place unless he was up to no good. I doubt very seriously he acquired this gun legally. What is wrong with our youth. Parents please get involved with your kids, know what they are doing, ask questions, find out who their friends are.

      1. That’s for real. To many young kids are taking over the jails. To many parents trying to be they child’s friend instead of they parent.

    4. Exactly what does 38.02 have to do with this story? Is it because the story says the others were identified sand released? You must be one of those cop haters who thinks that the cops shouldn’t be allowed to ask a car full of people, one of whom just fired a weapon, to identify themselves. They can ask you whatever they want; you can decide whether to oblige or not. I must have missed something in the story that set you off.
