A Brenham couple, arrested amid a deadly shootout at a Waco restaurant last May, have been cleared of all charges.

Attorneys representing William and Morgan English say the the grand jury did not seek to continue with their cases. The two have been released and face no further charges.

Attorney Paul Looney says the extended term of the grand jury expired Thursday at midnight without an order extending the prosecution.  Thus, the prosecutions against the 39 unindicted bikers were terminated and their cases dismissed.

The Englishes say they arrived at the Twin Peaks restaurant in Waco, just minutes before the shooting started on May 17.

Rival biker gangs are believed to have clashed, and when authorities arrived on the scene, shots were exchanged between all the groups.

Nine bikers died and 18 were injured.

Approximately 170 people were charged with engaging in organized criminal activity.
