CITY COUNCIL RESPONDS TO SB 1004 LAW

Brenham City Council passed two items today (Thursday) designed to give them some control over the construction of wireless network nodes in public right of ways.  A bill passed by the Texas Legislature would give wireless providers that right after September 1st.  Up to this point the city has denied requests by providers to locate their equipment on poles throughout the city.  With the passage of Senate Bill 1004, providers can now add their equipment to existing poles or construct new poles in the city right of way.  Wireless providers are looking at placing nodes every 300 to 500 feet for the deployment of their 5G network.  With the ordinance and construction standards pass today by city council, the city will have some control over that.  Erik Smith, Brenham Development Services Director, explained to the council that the construction standards would require that the nodes could only be placed on streets wider than 50 feet.  That would eliminate them from most residential areas.  He also said the standards would limit the nodes to one per pole.
