DEVELOPER CHARLES VON SCHMIDT ACQUITTED OF CHARGES

  

The man who unsuccessfully tried to bring a controversial auto racetrack to the Chappell Hill area has been acquitted of all charges by a jury in Polk County.

Charles Von Schmidt was indicted in 2015 on 5 charges that included securing the execution of a document by deception; hindering a secured creditor; tampering with a government record; fraudulent filing of a financing statement; and making a false statement to obtain property or credit.

The case revolved around Von Schmidt’s purchase of interest in properties in the Cedar Point Subdivision on Lake Livingston.

After a weeklong trial, a jury found Von Schmidt innocent of all the charges.  The trail was held in the 411th District Court in Livingston.

In 2014, Von Schmidt and Club Track Holdings made 2 attempts in Washington County to purchase land to develop a club race course.  The first location was off of Wonder Hill Road, just outside of Brenham.  He then planned to develop a track on property near Chappell Hill.  That plan was scrapped after a group of local property owners filed a civil lawsuit in 21st District Court seeking to halt construction of the facility, as well as massive public backlash. The suit was never heard, as Club Track Holdings announced they had found a new location outside Washington County.
