CYPRESS MAN ARRESTED FOR POSSESSION OF MARIJUANA

  

A Cypress man was arrested Tuesday night in Brenham for marijuana possession.

Shortly after 8:30 p.m., Brenham Police Officer Grayson Marburger stopped a vehicle in the 2200 block of South Day Street for a license plate violation.

Officer Marburger made contact with the driver, 23-year-old Santana Ramos III, and could smell the odor of burnt marijuana coming from inside the vehicle.  Marijuana was located after a probable cause search of the vehicle.

Ramos was taken into custody for Possession of Marijuana under 2oz and transported to the Washington County Jail.

    1. Yes, it does.
      Burning or possession of Marijuana, or paraphernalia, is still illegal in the state of Texas.
      I do not agree with it, or with all of the arrests for Marijuana, but that is the law for now.
      One day, it will be legal in Texas as well. Until then, don’t stink like weed when you get pulled over.

    2. Sorry, Brad. Actually, it does, according to the Texas Court of Criminal Appeals:
      “Quite simply, the smell of the marijuana or its smoke emanating from a vehicle constitutes facts and circumstances sufficient to warrant a person of reasonable caution to believe that a controlled substance has been or is being possessed or delivered or both, and, thus, that a violation of law has occurred or is occurring.” (17) ”

    3. And that’s where your wrong. It has long been probable cause in Texas. It’s wishful thinking to believe otherwise. There is zero excuse to be driving under the influence.
