BRENHAM MAN RECEIVES PROBATION FOR FELONY D.W.I.

A Brenham man has been placed on probation for his conviction on a felony DWI charge.

34-year old Clayton John Witte of Brenham pleaded guilty to Driving While Intoxicate—3rd or More Offense, a Third Degree Felony.

Witte was arrested back in March of this year.

Judge Reva Towslee Corbett also fined Witte $1000, ordered him to undergo drug/alcohol evaluation and treatment, attend DWI education class and perform 100 hours of community service.

He was also ordered to spend 10 days in the Washington County Jail within the next 90 days.

  1. It is “who” you are which dictates justice as much as your resources. In this area of Texas, surname origins, just as race, dictate justice, political wins, employment, etc. . This is an indisputable fact based on history. It is undeniably tribal thinking. The same ingrained attitudes which thru the centuries have killed millions. All in all, have we really progressed or as evolved as we think we are?

  2. This is not justice in my opinion. My brother had 3rd Plus and got 3 years. Hopefully this guy learned his lesson but with a slap on the wrist? Hopefully he doesn’t pull it again wipe out a whole family. This judge should definitely serve 10 years then. This is an atrocity had to be kin, buddies or something no justice in Washington county at this rate.

  3. This is yet another example of a two tiered justice system. The person who can afford a good attorney, gets a slap on the wrist over and over, while the person who cannot afford an attorney, gets the book thrown at them!

  4. Yes I know. 6 years ago my friend and I were involved. In a head collision by a drink driver causing me to break my C2, the doctors said if I would have moved a fraction of an inch , I would have been dead or paralyzed. This was her fourth DWI, she had her lucsensef suspended at the time, and she had just got out that morning fro WC jail serving weekends for her third DWI. She also had Zanex on her possession. She got 5 yrs in prison, which I thought was light sentence for a fourth DWI. She will probably get out next year and do the same thing again, and hopefully she won’t kill someone, mine or your family member. I’m still suffering the effects from that accident and will the rest of my life, because my body went through a near death experience.

  5. From the Texas Dept. of Transportation website:

    Third Offense*

    A $10,000 fine
    Two to 10 years in prison
    Loss of driver license up to two years
    Annual fee of $1,000, $1,500, or $2,000 for three years to retain driver license
    *After two or more DWI convictions in five years, you must install a special ignition switch that prevents your vehicle from being operated if you’ve been drinking.

    Does anyone making decisions know the extent of the law?

Is this a mistake? 3rd offence should have 2 to 10 year prison time as well as additional penalties including: a mandatory ignition breathalyzer, much more in fines, much more community service, and he should lose his license. I am very concerned about REPEAT DWI drivers posing a huge threat to others as their pattern of behaviour shows the lack of compliance to a safe society. How can this be right? Was something not reported correctly, was there an evidentiary problem with the case? I am blown away. I predict a future offense and just “Pray to J” that no one I know will be his future victim. This seems wrong!!!

    1. Sadly it happens more than you know. My sister was hit by a drunk driver at the end of November 2013. The man that hit her had multiple, well over three, convictions. He did not stop. It was hit and run. The only way he was caught was when he hit a pole by the street which disabled his vehicle. She never was able to return to her job. She loved her job and her life! He had no insurance on the vehicle he was driving which was not his. He was sentenced but was released early. He was also convicted in another county and received a similar sentence. She was recently notified that he is in trouble again. He showed no remorse in court and he has gone on about his life. My sister was disabled and her life was changed forever.

  7. This is insane. How many chances are the courts going to allow him to kill someone? Was his license suspended? How soon will he be back on the roads driving his deadly weapon?

  8. Wow, 3rd or more offense and he gets PROBATION AND 10 DAYS IN COUNTY JAIL(WEEKENDS). SMDH

    1. All I can say is WOW, I hate to pull the race card but I mean really probation for 3rd offense? WOW!! Hopefully it doesnt have to do with race, but what other factors allow him yo get off so easily? I hope he realizes how lucky he is and changes his ways!!!
