BRYAN MAN CONVICTED OF KILLING BABY PUSHES FOR NEW TRIAL

38 year old Talawrence Tennell of Bryan was convicted in April of this year for the beating death of his girlfriend’s 7 month old daughter, Hailey Burleson.

Tennell was high on PCP at the time, but in a hearing held Friday, his defense attorney claims the Brazos County District Attorney’s Office withheld crucial evidence that would have changed the outcome of his charge, and that a potentially beneficial witness statement was even omitted.

The defense claims that Tennell accidently spilled the PCP on his jeans, and absorbed it through his skin.

Friday’s motion for a retrial in the 85th District courtroom had Tennell’s defense attorneys pushing that statements from the mother, Crystal Harris, were not submitted by the prosecution, and would have helped shown he had no intention of getting high.

Harris had told investigators that when she returned home, she had noticed Tennell had changed out of the pants she had last seen him in; a statement never given to the defense team.

 

Tennell has a life sentence for capital murder with no chance of parole, and his attorneys are hoping he’ll be granted a new trial where they can seek a lesser charge, such as involuntary manslaughter.

District Judge Kyle Hawthorne is reviewing the case and arguments through the weekend, and expects to have a decision no later than end of business day on Tuesday.
