FLENNIKEN LAWSUIT DISMISSED

  

Retired 21st District Court Judge Terry Flenniken credits the law and the judicial system for dismissing a lawsuit filed against him  from an anti-abortion group charging he improperly placed a juvenile girl in the custody of her step-grandmother who was living with a convicted sex offender.

The 335th District Court in Burleson County dismissed the charges Monday with the court ruling that there was ‘no good faith basis for the assertion of the claims made by the Texas Center for the Defense of Life.  Judge Flenniken said in reaction that this is the kind of thing that judges can expect but the law in this case prevailed.

 

 

The plaintiffs charged that Judge Flenniken placed the 15-year old juvenile girl with her step-grandmother even though she was living with convicted sex offender Edward Clinton Lee.  They charged he was making aggressive advances towards the girl and wanted her to have an abortion.

Six months after the ruling, Lee shot and killed the grandmother but the girl was able to escape. 

Judge Flenniken says the girl never stated that she felt she was in danger and was never presented with any evidence that she was in any danger.

Flenniken says he wishes the girl no ill feelings and says he looks forward to continuing as the senior judge for this judicial district.  Flenniken retired as the judge of the 21st district court at the beginning of the year after serving 12 years.
