BURGLARY UNDER INVESTIGATION

  

A lawn mower and an air conditioner are missing after a daytime burglary in Brenham.

Police say someone took a push mower and an A/C unit from a home at the 500 Block of West Tom Green.

The owner says the burglary occurred sometime between 11:50 a.m. and 5:00 p.m., Monday.

Police say there was no sign of forced entry.  Their investigation continues.

  1. The Police Department agrees with you in part that our justice system needs to be tougher on repeat/habitual offenders. However, it is a misperception that searching cars is ineffective in fighting crime. The truth is, criminals pick and choose the time and place of their crimes. They have lookouts, they listen to scanners and can hear us coming from blocks away at night. The one thing they can’t control are the roadways they use going to and from those crimes. Any city that has lowered and maintained that decrease in crime conducts many traffic stops. Most burglars, thieves, drug users/traffickers and wanted people are caught in traffic stops. It’s just one tool we have to combat crime.

    The point is well made that officers make a lot of misdemeanor marijuana arrests. Often times, if not most the time, these arrests are made on habitual criminals like burglars and thieves. Police officers only have discretion on class C offenses, which include traffic charges, drug paraphernalia, etc. With Class B offenses and higher, the officers have no discretion but to enforce the law. In areas where officers don’t normally arrest for small amounts of marijuana (anything under two ounces is a Class B misdemeanor) it is the prosecuting authorities who have made the decision not to arrest. Instead they have chosen to utilize the Class C charge of possession of drug paraphernalia. It is not the police that made those decisions; they don’t have such authority.

    It should be understood, that when a habitual offender is in jail for any amount of time and for any legal charge – at least for that period of time they are in jail – they aren’t burglarizing cars, breaking into homes and committing other crimes. This is why traffic stops, our investigative activities and arrests of habitual offenders are effective. We as law enforcement can’t stop all chaos but we can stop chaos from taking over all things. Chief Rex Phelps is simply saying we are doing all we can to educate our public and support each other to make this the best place to live and do conduct business. If we get information that a certain person is committing crimes, but we haven’t caught him in the act but we have found him in possession of marijuana or any other criminal offense, we can put him in jail at least for a period of time. And that has a positive effect on our crime rate. Occasionally first time offenders are arrested for Class B misdemeanor charges. Remember, it is not our discretion at this level. In the end, the law is the law. We all have an obligation to abide by our laws. Please know that any time there becomes a saturation of illegal drugs in an area there will always be more thefts, more burglaries, more robberies and more assaults. Illegal drugs are simply not victimless crimes. This is why law enforcement work to keep the illegal drug trade curtailed as much as possible.

  2. What is happening in this town is called deferred adjudication. A high percentage of crimes go through the court system and end up this way. I know one case a person broke into my parents house and two others, this person was arrested and released on bail, while on bail this same person committed more of the same crimes and was arrested released and again repeated the same. When his day in court came….. deferred adjudication. How are we going to stop criminals if they keep letting them walk amongst society on probation. The police force is so intent on searching cars rather than stopping crime. I know they have found a lot of drugs (mostly marijuana) but the majority of these stops are misdemeanor possession charges, and is commonly mistaken for stopping crime.

  3. What is happening to this small town?? everyday I read of something stolen. . . I feel like I am living in Houston or some other big city. . as I see the age group on some of these once these people are caught (and that’s if they are caught) it has me wondering where are the parents to these kids? When are the “parents” going to GROW UP and be PARENTS! Behavior and respect all start at home no matter how many parents try to blame it on someone else. . If you the parent taught your kid better young on and showed love and support at home maybe there would not be so much crime. Being involved with your kids from little on up is the best way to keep your kids (and then young adults) focused on positive things.
    And for those who just can’t seem to keep out of trouble, when is the law going to change from a slap on the wrist to some actual “do the crime pay the time”. . until the laws change with harder punishments, especially for repeat offenders, this is going to continue to always be a problem. .
