TEXAS HOUSE APPROVES OPEN CARRY LEGISLATION

  

The Texas House on Monday gave final approval to legislation that would allow holstered handguns to be carried out in the open.

The measure, House Bill 910 was approved 101-42, and will now go to the Senate, which has already approved a similar measure.

The author of the Bill, state Rep Larry Phillips, R-Sherman believes there will be mo problems with the Senate agreeing on minor differences between the new bill, and Governor Greg Abbott has indicated that he would sign the bill into law.

The bill will allow those will a concealed handgun license to openly carry the weapon in a shoulder or belt holster.

A prohibition against law enforcement stopping a person with a holster weapon solely to ask wither he has a license, was added to the House Bill on Monday.

Democrat Rep Rafael Anchia of Dallas attempted to add an amendment allowing large metropolitan cities to allow their own elections to decide whether to allow open carry, which would allow a rural standard and an urban standard, but the amendment was defeated 97-45.

  1. This Open Carry bill is only for CHL holders. Since we have carried concealed (me for 18 years) for such a long time, I doubt you see much, if any, openly visible firearms. Why, I want the element of surprise to the bad guy. Plus, a Armed Society is a Polite Society. I’ll remind Politely Concealed – Always Heavy and Ready.

    1. I have had my CHL since they became available, but honestly don’t carry the vast majority of the time. The reason being, as I understand the law, if someone sees my weapon, I have violated the law and can be charged with a crime. I am not 100% this is accurate, but I don’t want to take a chance. It is very hard to totally conceal a viable weapon during most of the year in Brenham Texas because of the weather unless you want to wear a coat in August. I am all for this solely for that reason. But wait, should I really need this law to be legal? Doesn’t the Constitution do that?

        I recently took the Course for the CHL. The instructor was asked about what you mentioned. The law has been structured since 2013 that it is not illegal for someone to see your gun. There are times when the wind might blow your coat open or your reaching over the table at a restaurant for the salt and pepper and your shirt comes up over your covered gun. It happens, and your protected by the law. Matter of fact in Texas not one person has been charged we were told for the gun being accidently seen. But, if you brandish your gun willingly in public, that’s a no no and yes you then have broken the law.
