THREE ARRESTED AFTER GUN WAVING INCIDENT

  

Three persons were arrested Sunday around 2:30pm to the 1700 Block of W. Main after a caller reported having a gun pointed at her.

The caller said a male subject had popped his head out of the window of an apartment and waved a gun around. She said a second person also had a weapon. When officers arrived at the apartment complex, they saw several men gathered in the parking lot, apparently about to fight.

Once the subjects were separated, it was found that incident was unrelated to the weapons call.

Cpl. Justin Schiller made contact with the subject in the apartment, who denied having a weapon.

Schiller also told Cpl. Seth Klehm that he had been approached by a woman who said that one of the people in the parking lot had placed a bag in her vehicle prior to the officers arrival and said she believed it possibly contained the weapons and narcotics.

Klehm deployed his K9 partner who performed a “free air” sniff around the vehicle and alerted Klehm to the presence of narcotics in the vehicle.

Klehm informed the woman who owned the vehicle he was going to conduct a probable cause search of the car, which was unlocked. During the search, the bag was found and opened. It contained a large plastic bag with what appeared to be marijuana along with a scale and several smaller baggies which appeared to be packaged for sale. At that point, the woman, twenty-four year old Jamie Danielle Bolin, was detained.

Klehm met with the subject who made the call regarding the weapons who said she had parked her vehicle in front of the stairwell so her passenger could get clothing from his residence. While she was waiting, she saw a male subject, nineteen-year old Marckell Lee Burns, stuck his head out of the window and yell at her passenger. He also waved a pistol around and said he would shoot.

As she was watching, she heard a small clicking sound and turned and saw another male subject standing in the stairwell pointing what appeared to be a weapon at her. At that point, the passenger got back into her car and they left.  The woman Klehm had detained for possession of marijuana said she was a resident of the apartment in which the man had been seen, but refused their request to search the apartment. At that point, Klehm returned to the police station to meet with the detective on call to obtain a search warrant.

Det. Mike Davis contacted District Attorney Julie Renken who also came to the station and spoke with the woman who had made the original call. Other officers remained on location to ensure no one left the apartment until the search warrant was completed.

While Klehm was waiting for the warrant, he met with the members of the department’s Special Response Team since it was believed there were multiple subjects and weapons involved. Officers at the location notified Klehm that they had two subjects detained.

Klehm and the SRT arrived at the apartment complex and spoke to the subjects. One was the subject who had allegedly waved the weapon. The other man was released

Det. Davis arrived with a search warrants as well as an arrest warrant for the man who had waved the weapon. During the search, two weapons were found, as well as a subject, twenty-six year old Anthony James Rogers, hiding in the air return who was identified as being wanted.

Marckell Lee Burns, of Burton was charged with Deadly Conduct

Anthony James Rogers, of Brenham was arrested on a Warrant for Driving with License Invalid with two previous convictions
