COURT DENIES REQUEST FOR PARTIAL NEW TRIAL IN BRENHAM VET CASE

  

The Brenham woman who is fighting to keep her veterinarian license after being accused of animal cruelty, received bad news concerning her appeal for a partial new trial.

Judges with the State Office of Administrative Hearings have denied a partial new trial for Kristen Lindsey. Lindsey is accused of animal cruelty after she posted a picture on Facebook in which she is seen having shot a cat with a bow and arrow.

Her attorneys contested that testimony by Houston feline veterinarian Dr. William Folger was inconsistent with statements he had written prior to his appearance in court. In court, Folger had testified that the cat in the picture was “absolutely alive” when the photo was taken.

The court, having reviewed the evidence, stated that the motion for a partial new trial is “premature”. The request for Dr. Folger’s testimony to stricken from the record was also denied.

A decision on whether Lindsey’s license will be revoked isn’t expected until October.
