Cpl Lance Weiss conducted a traffic stop in the 600 block of E Main, and the driver of the vehicle got out of the car, ignoring Weiss’ commands to stay seated. The driver was unsteady on his feet, and Weiss said he could smell alcohol on the man’s breath as well.
Officer Kevin Mertz arrived to assist, and as Weiss walked around the car, he could see an open container of alcohol sitting in plain view in the center console.
The driver, sixty-five year old Bishop Lee Davis, Jr. was detained, and during a search, a baggy of marijuana was found in his shirt pocket.
His driving records showed two prior convictions for driving under the influence of alcohol.
Davis was charged with Driving While Intoxicated, Third Offense, and possession of marijuana under 2 oz.
