CHANGE OF VENUE DENIED IN HEMPSTEAD LANDFILL CASE

  

The civil trial over a proposed landfill near Hempstead is now set to begin December 1st in the 506th District Court in Waller County.

Retired District Judge Terry Flenniken has denied a change of venue request made by Dallas based Pintail Landfill Company.  The company had asked to move the case out of Waller County due to local prejudice and publicity over the landfill they plan to operate near Highway 6.  Waller County residents have been fighting the landfill ever since it was announced three years ago.

The City of Hempstead and the group “Citizens Against the Landfill in Hempstead” are suing Pintail Landfill Company, saying the project was discussed and pushed forward illegally through backroom talks between developer Green Group Holdings and Waller County officials.  Other defendants named in the suit include former Waller County Judge Glenn Beckendorff and Commissioners Frank Pokluda, Stan Kitzman, Jeron Berrett and John Amsler.

With Judge Flenniken’s ruling, the trial can now proceed in Waller County on December 1st.   Flenniken was appointed to preside over the case after 506th District Judge Albert M. McCaig Jr. recused himself.
