UT ENDS SCHWERTNER INVESTIGATION

State Sen. Charles Schwertner

The University of Texas has ended its sexual misconduct investigation into State Senator Charles Schwertner, saying “based on available evidence” Schwertner did not violate university policy.

However, the university went on to say that Schwertner would not fully cooperate with their probe into allegations he sent inappropriate text messages to a university graduate student.

A report released Tuesday by the university said Schwertner’s failure to cooperate prevented investigators from reaching a definitive conclusion and raised the possibility that an unknown person who claimed responsibility for the messages is "being untruthful or does not exist."

The report was signed by former U.S. attorney Johnny Sutton. The university hired him after a student this fall accused Schwertner of sending inappropriate sexual text messages that included a nude photo with the face cropped out.

The report says Schwertner's lawyers claimed another person sent the messages but wouldn't say who that person was.
