SEN. KOLKHORST ASKING TEXAS AG TO INVESTIGATE DETAILS OF INDUCED TERMINATION OF PREGNANCY REPORT

State Senator Lois Kolkhorst (R-Brenham) is asking the state to look into the details of a new report that shows at least six infants were born alive during abortion attempts in Texas in 2019.

Kolkhorst has requested the Texas Office of the Attorney General to investigate the circumstances of the data included in the Texas Health and Human Services Commission’s “Induced Termination of Pregnancy” report.

During the 86th Legislature, Kolkhorst sponsored and passed the Texas Born-Alive Infant Protection Act with State Representative Jeff Leach (R-Plano).  The law requires abortion doctors to administer proper medical treatment for infants born alive after a procedure, and includes civil and criminal penalties for physicians who fail to do so.

Under the law, physicians who do not provide appropriate treatment can be liable to the state for a civil penalty of not less than $100,000, along with criminal penalties, to be collected by the state attorney general.

Kolkhorst said in her request to the Attorney General that she is “heartbroken to read that these horrific events continue,” adding, “These tragedies are the exact reason why I worked to pass the Texas Born-Alive Infant Protection Act.”  She said while federal laws covering these instances are still unclear, Texas law is “now very clear.”  She said, “Every baby born in Texas is going to be respected as a human being.  Texans must stand united to protect innocent life.”
