ACCIDENT LEADS TO LOCAL D.W.I. ARREST

A Thursday accident in Brenham has led to DWI charges.

Just after 6:30 p.m. officers responded to a report of a crash in the 2700 block of South Chappell Hill Street.

Upon arrival, the driver, 57-year-old James Kincheloe of Bertram, was arrested for Driving While Intoxicated 3rd or More Offense and Driving While License Invalid – Enhanced.

Kincheloe was taken to the Washington County Jail.

  1. 3 or more driving drunk offenses and no license just proves the court system is a complete joke. Obviously this guy hasn’t learned his lesson so why was he released back on the streets when authorities know he’ll probably repeat offense again? This time I hope the court system learned their lesson! The court is just as much responsible for this as the offender is. Just sayin!

      First offense
      Up to a $2,000 fine.
      Up to 180 days in jail upon conviction
      with three mandatory days.
      Loss of driver license up to a year.
      Second offense
      Up to a $4,000 fine.
      One month to a year in jail upon
      conviction.
      Loss of driver license up to two years.
      Third offense
      A $10,000 fine.
      Two to 10 years in prison.
      Loss of driver license up to two years.
      These fines do not include a state fine of $3,000, $4,500, or $6,000 assessed upon sentencing.
      HOWEVER, THE JAIL TIME AND LOSS OF DRIVER’S LICENSE MAY BE PROBATED AND NOT ACTED UPON RESPECTIVELY. This factor merely shows the discretion that a judge or jury might have when sentencing a person convicted of DWI. It does seem strange though, doesn’t it…? It would seem to me that 10 years in prison, without any alcohol, would make a giant leap forward in their alcohol addiction recovery program.

    2. This kind of judicial enforcement (or lack thereof) assures that attorneys, judges and court support systems keep profiting! Crime really does pay! And that is the real truth …. ruth! Illegal activity is encouraged by our antiquated racist judicial system.
