BURTON SCHOOL BOARD PROCEEDING WITH LEGAL ACTION ON BOND PROJECT

  

Burton ISD is moving forward with a lawsuit concerning the bond construction project.

The Burton School Board on Monday met in executive session to consider a resolution for legal action regarding construction damages and breach of contract.  The board agreed to authorize outside counsel to file a lawsuit for the damages and breach of contract.

When asked to clarify if the board’s decision pertains to the district’s previous construction manager-agent, DSA Inc. or another entity, Superintendent Vikki Curry said, “Further details about the legal litigation will be provided at a later date as the situation develops.”  She did confirm, though, that this does not involve the current construction manager-agent, Weaver & Jacobs Constructors, who she said has been doing well with construction and ensuring progress is being made. 

Trustees approved a resolution in August to authorize the superintendent to not pay invoices to DSA for the bond project.  The resolution stated that Burton ISD has received invoices from DSA that the company claims are past due, but there is a dispute between the company and the school district over the goods delivered or services performed.

In June, the district terminated its contract with DSA and entered into a new contract with Weaver & Jacobs Constructors

The board also took action out of executive session for the possible participation of homeschooled students in the district’s extracurricular activities.  Trustees opted to not allow homeschoolers to participate at this time.

In regular session, the board received the district’s 2023-24 audit report.  April Charlebois of Singleton, Clark & Company informed the board that the district had a “clean” audit with an unmodified opinion and no findings of material weakness or significant deficiencies.  She said the firm believes the district’s business office is doing a “really good job” with financial processes and controls.

Board members also recognized students involved in fall extracurricular activities, including members of the football and volleyball teams.
