BRENHAM RESIDENT WINS COURT JUDGEMENT
A Brenham resident has won a judgement against an alarm company for fraudulently signing his name to a five-year service contract. Marc Upchurch won the judgement this week in Justice of the Peace Ken Tofel’s court. The judgment resulted in an award of $9921 to Upchurch, which included $6250 in punitive damages. The alarm company, Alder, is a nation-wide home security company.
Sylvia Cedillo of Hempstead represented Upchurch in the court. She successfully argued that Alder’s representative visited Upchurch’s home in July of 2019 and secured personal information that resulted in Alder wrongfully auto-drafting his bank account for months. She also argued that Alder’s representative promised that they offer discounts for military service, when in actuality, they do not. Upchurch testified that Alder endlessly harassed him to collect money and threatened to harm his credit rating.
