FAYETTEVILLE MAN FOUND GUILTY IN BRAZOS COUNTY

  

A Brazos County Jury has convicted a 31-year-old Fayetteville man of pulling a gun on two people during an apparent case of road rage in 2011.

After a two hour deliberation, a jury convicted Herman Jerome Harris Jr. of one count of aggravated assault with a deadly weapon, a second-degree felony punishable by two to 20 years in prison and a $10,000 fine, and one count of deadly conduct, a Class A misdemeanor, punishable up to a year in jail and a $4,000 fine.

Harris was originally indicted on two counts of aggravated assault in February of 2011 after police responded to a complaint about a man pointing a gun at two people in a car on Texas Avenue and threatening to kill them.

Harris had gotten into an argument with the two people after nearly hitting their car while at a convenience store. The defendant followed them out of the parking lot, down Texas Avenue, shouting threats and waving a gun.

Police located and detained Harris, and, after searching Harris, police say they obtained his keys and located his car, which was searched for weapons. Police found a gun case and .40 caliber ammunition, but no gun was found during that investigation.

Defense attorney Arthur Washington argues that his client’s case was one of mistaken identity, and that the description of the car given by witnesses was not consistent.

Jurors will be back this morning for the punishment phase of the trial. Harris is eligible for probation.
