COURT OF CRIMINAL APPEALS ORDERS BRENHAM MAN TO CARRY OUT PRISON SENTENCE

  

A Brenham man has been ordered to serve out a five-year prison sentence, after exhausting his appeals for a 2012 drug delivery case.

26-year-old Sage Nutt was taken into custody last Thursday during the District Court docket, according to a release from the Washington County District Attorney's Office.

Judge Carson Campbell ordered that the sentence be carried out, according to a mandate issued by the Texas Court of Criminal Appeals.

Sage Nutt was indicted on three counts of Delivery of a Controlled Substance in August 2013, after a series of undercover narcotics purchases a year earlier.  Nutt was convicted and sentenced by a jury to five years in prison, in March 2017.  He was immediately released on an appeal bond.

On July 26, 2018, the Court of Appeals in Houston affirmed the conviction and denied Nutt’s appeal.  Nutt appealed that decision and filed a petition for review with the state’s highest criminal court, the Court of Criminal Appeals.

That petition was denied on November 7^th, and just before the end of 2018, the Court issued the mandate ordering the sentence from the jury to be carried out.
