A former Burleson County Jailer found himself on the other side of the bars after turning himself in for having an improper sexual relationship with a female inmate.

29-year-old Marshall O’Donnell of Caldwell was charged with a second-degree felony for Improper Sexual Activity with a Person in Custody.

Chief Deputy Bill Rios told the Burleson County Tribune that the Sheriff’s Office was made aware of the situation on November 24. O’Donnell resigned the next day after being questioned about it.

The Burleson County Sheriff’s Office with the assistance of the Texas Rangers investigated the case and secured a felony arrest warrant.

O’Donnell turned himself in to the Brazos County Sheriff’s Office on Tuesday, and bond was set at $6,000.

According to Rios, they arranged for O’Donnell to be incarcerated in Brazos County for his own safety, but he was to treated like any other inmate, and receive no special treatment.

The Burleson County Sheriff’s Office released a statement saying, “Sheriff Gene Hermes, along with employees of the Burleson County Sheriff’s Office, take our positions seriously. We will not tolerate any employee that breaks the law, or violates the trust instilled in them.”
