SHAREHOLDER LAWSUIT AGAINST BLUE BELL REVIVED
A court in Delaware has revived a shareholder lawsuit against Brenham’s Blue Bell Creamery.
Delaware's Supreme Court overturned the original dismissal of the lawsuit, filed after a 2015 listeria outbreak.
The court ruled Tuesday that a previous judge had erred because the plaintiff had not demanded that the board of Blue Bell Creameries take action itself before the lawsuit was filed.
That demand requirement can be waived if a plaintiff raises reasonable doubts about the impartiality of directors because of close ties to management. Former CEO Paul Kruse is a defendant in the suit.
The court also said the lawsuit adequately alleges that the board at Blue Bell failed to implement any system to monitor food safety performance or compliance.
The deaths of three people have been linked to the listeria outbreak.
Update: KWHI has reached out to Blue Bell for comment, and was told the company does not comment on "ongoing legal matters".
I am so sorry for the loss of the three lives because of the mistake that blue Bell made but blue Bell ice cream is the best ice cream I’ve ever clean and I just love the millenium crunch I eat a gallon a week of it I can go to sleep without having a cup full of it is the best ice cream ever and I’m so sorry that they made that mistake and I’m quite sure they are to everybody makes mistakes in this was a new fairly new company to Virginia and they had no idea of what they had to do to maintain the proper level of safety now that they do please give them a break
So what does the state of Delaware have to do with this lawsuit, are there shareholders in that state?
