WALLER COUNTY SEX OFFENDER SENTENCED TO 20 YEARS IN PRISON

  

More than three years after pleading guilty to child indecency charges, a sex offender was sentenced to 20 years in prison on Thursday in Waller County.

On May 2nd 2013, John Araiza pled guilty to indecency with a child by sexual contact and was placed on sex offender community supervision for a period of 10 years. Indecency with a child by sexual contact is a second degree felony, which carries a punishment of up to 20 years in prison and a $10,000 fine.

The Waller County Criminal District Attorney’s office sought to revoke Araiza’s probation for numerous failures to satisfy the terms and conditions of his community supervision. Assistant Criminal District Attorney Noah Johnson presented evidence and testimony at the sentencing hearing showing that Araiza had failed to attend required sex offender courses or complete court ordered sex offender counseling, or complete required community service hours.

As an excuse for his non-compliance with the terms and conditions of his probation, Araiza claimed that his non-compliance was the result of his wife’s terminal illness and subsequent death. Johnson produced evidence at the hearing that Araiza’s wife was, in fact, alive and well, and that there was no evidence of her ever having a terminal illness.

In his closing argument to the Court, Johnson stated that a 20 year sentence was the only appropriate punishment because “There was no way for the court to know what to believe when it came to Mr. Araiza’s excuses. If he’ll lie to the court twice about his own wife’s death, what won’t he lie about to avoid his obligations?” The Court agreed, and assessed the maximum possible punishment against Araiza for his crime.

Araiza will not be eligible for parole until fall of 2026.

  1. Actually in Texas it’s been a joke on re-hab on sex offenders in Texas for the last 16 years. The prisons are in it for the $$$, not helping people. Google it.

    1. Sex offenders can not be rehabilitated. I have interviewed several, and they all admit that the urge never goes away. Do some research and you’ll see.

      1. Mr. Dover, based on everything I’ve seen, you are correct. These people need special treatment, but unfortunately by the time that is realized, it’s too late.

  2. I’m glad I live in Texas where we take abuse serious and put these guys behind bars. I would also say treatment might help, but that don’t do that in Prisons.

    A couple weeks ago a Judge in Utah sentenced a creep to only 30 days in jail for sexually abusing his 11 year old daughter.

    1. If you research sex offender treatment in Texas, the prison system actually has the best resources for offering rehab to sex offenders.
