LEE COUNTY HIRES LAW FIRM TO REPRESENT THEM AGAINST COMPOST FACILITY

  

Faced with the prospect of a compost facility moving into the area, the Lee County Commissioners Court has approved the hiring of an attorney.

Lee County has hired the Austin-based firm of Allison, Bass, & Magee LLC to represent their interests.

County Judge Frank Malinak told the Giddings Times that the reason they hired the law firm is to ensure that the County’s ordinance against solid waste disposal that was adopted in 2018 can be enforced.

Break It Down LLC of Austin, which is owned by Jeff Paine, purchased sixty acres of land on Private Road 3264 off of County Road 326 near Lincoln to be used as a compost facility.

Paine has filed for a permit from the Texas Commission on Environmental Quality.

Lee County has received support in recent weeks from Washington County and the City of Brenham.

All three governing bodies have issued resolutions protesting the proposed facility regarding the possible environmental effects to Lake Somerville,  strong odors that could detract from air quality, an increase in vermin and pests, damage to roads and other infrastructure due to increased truck and trailer traffic, noise pollution from operating equipment, and interference with nearby rural property owners.

Washington County and the City of Brenham have chosen at the moment to not hire legal counsel at this time, but have discussed the issue at previous meetings.
