CRIMINAL APPEALS COURT DENIES REHEARING IN COLLEGE STATION CAPITAL MURDER CASE

The Texas Court of Criminal Appeals has denied a rehearing in the 2015 capital murder conviction of a College Station man.

On Wednesday, the court denied a motion for rehearing from 28-year-old Gabriel Hall, who was sentenced to death for the murder of retired Texas A&M University professor Edwin Shaar and the stabbing of his wife, Linda, at their home in College Station in October 2011.  Hall attended A&M Consolidated High School at the time.

Hall’s defense team appealed his sentence in 2019, citing concerns about a video featuring an interview with comedian Jeff Ross that was shown to the jury before Hall was sentenced.  In the video, Ross interviewed Hall and other inmates at the Brazos County Jail.

Hall’s defense attorneys argued the relevance of the video and said they were not notified about the interview, which was used against him at trial.  The Court of Criminal Appeals upheld his murder conviction and sentence in December.

Hall will be able to file a writ of habeas corpus at the state and federal levels to move to introduce new evidence.  He remains on death row at the Allan B. Polunsky Unit in Livingston.
