BRENHAM CITY COUNCIL TO DISCUSS RESTRICTIVE COVENANTS FOR URBAN DEVELOPMENT

  

The Brenham City Council will meet Thursday to discuss urban development.

The council will consider approving an agreement to amend the restrictive covenants governing the Brenham Oaks Apartments development to secure financing insured by the U.S. Department of Housing and Urban Development (HUD).  The council will also consider an agreement concerning the city’s release from said restrictive covenants.

In 2002, according to a memo from City Attorney Cary Bovey, the apartment complex off Stringer Street obtained Low Income Housing Tax Credits from the Texas Department of Housing and Community Affairs (TDHCA) to financially assist in the development of the apartment project.  As a condition of receiving the tax credits, the developer of Brenham Oaks was required to record certain restrictive covenants against the property used for the project.

In 2007, the city conveyed a 0.88 acre parcel of the property for public right-of-way.  The property is still subject to the TDCHA restrictive covenants, and as such, the city’s consent to the HUD amendment to the restrictive covenants is required for the developer to obtain the financing.  The city is also asking that the developer apply to the TDHCA to release the city’s property from being subject to the restrictive covenants, to prevent an issue like this from occurring in the future.

Also in session Thursday, the council will act upon a ground space lease agreement with Aviators Plus for fuel farm operation and the construction of a hangar at the Brenham Municipal Airport.

Also at Thursday’s meeting, the council will:

  • Consider a request for proposals related to banking depository services.
  • Discuss an audit engagement letter for Seidel Schroeder to perform an audit for the fiscal year ending September 30th.
  • Consider recommendations for appointments to various city boards and commissions.
  • Discuss approval of the proposed 2020-21 Fiscal Year budget for the Washington County Appraisal District.
  • Receive an update on the city’s COVID-19 response and recovery efforts.
  • Issue special recognition for the city receiving the Government Finance Officers Association (GFOA) Distinguished Budget Presentation award for the tenth consecutive year.
  • Proclaim September Childhood Cancer Awareness Month.

The council will meet Thursday afternoon at 1 p.m., at Brenham City Hall.
